Answer:
Pursuant to the Labour Code, the Employer is not required to conduct procedures for registering wage scales, wage tables but only need to consult with the organisation representing the Employees at the Grassroots level where it is located, for the CLA, the Employer only needs to send to the labour authority of the People’s Committee of the province. The procedure is as follows:
- Regarding the CLA:
Within 10 days as of the date signing a CLA, the Employer must:[1]
- Submit 01 copy of the CLA to a provincial-level State labour management agency as the DOLISA, specifically;
- Submit 01 copy to each signing party; and
- Regarding the effective sectoral or multi-level CLA, each Employer and each organisation representing the Employees of enterprise participating in the agreement shall be received 01 copy.
2. Regarding the wage scale and wage tables
The Labour Code does no longer regulate that upon formulating wage scales and wage tables the Employer has to submit their wage scales and wage table to the competent labour management agency. However, the establishment of the wage scale and wage table still shall be conducted in consultation with the organisation representing the Employees of the enterprise if any. In addition, when the establishment of wage scales and wage tables is completed, the Employer must announce wage scales and wage tables at the workplace before implementation.
